Identifying Relevant Financial Relationships

For educational activites that include clinical topics, activity organisers must ensure transparency and independence in content development.

Disclosure Requirements

  • All planners, educators and individuals involved in controlling educational content must declare any financial relationships with ineligible companies within the past 24 months
  • Conflict of interest Disclosure Form must be completed before taking part in the activity

Review of Financial Relationships

  • The Medical Organiser is responsible for reviewing all disclosures to identify relevant financial relationships
  • A relationship is considered relevant if it relates to the content of the activity and the business lines or products of the company involved

Restrictions on Participation

Individuals who are owners or employees of ineligible companies are generally not permitted to control content or act as planners or educators in accredited education.  There are three exceptions to this exclusion - owners or employees of ineligible companies can participate in the following circumstances:

  • when the activity content is not related to their company's business or products
  • when the content is limited to basic science or research methodologies, and no patient care recommendations are made
  • when acting as technical instructors on the safe use of medical devices, without advising on when or whether to use them
 

Mitigating Financial Relationships

To protect the independence and quality of educational activities, all potential conflicts of interest must be carefully reviewed and managed.

Review of Disclosures

The Medical Organiser must review completed Conflict-of-Interest disclosures from all individuals who have influence over the content of the activity (planners, speakers, faculty, authors etc).  The outcome of this review must be documented using the Medical Organiser Review Form

If an individual has had a financial relationship with an ineligible company within the past 24 months, they must also complete the Attestation Statement included in the Conflict-of-Interest Form  to confirm that the content is scientifically accurate and free from commercial influence.

As a further mitigation step, the Medical Organiser can conduct an independent review of the educational content when it is deemed necessary or appropriate.

All steps taken to identify and manage potential conflicts must be clearly documented by the Medical Organiser.  All activity files/records of CPD activity planning and implementation must be retained for a period of 2 years from the date of the activity.

Disclosure of Relevant Financial Relationships to Learners

The activity organiser must disclose the presence or absence of relevant financial relationships to learners before they engage in the CPD activity.

A clear statement must be provided to learners confirming either:

  • No relevant financial relationships exist OR,
  • Relevant financial relationships have been identified and appropriately managed

Presenter Disclosures

All presenters must include a disclosure slide at the beginning of their presentation outlining the following:

  • The name(s) of any relevant companies
  • The nature of the financial relationship(s)
  • OR confirm that no financial relationship exists, if applicable

Disclosures must remain neutral and must not include:

  • Brand logos
  • Promotional or marketing messages
  • Product trade names
